3. Revocation due to Delay


Q1542. A person bought some property from another person for a particular price on credit. They did not talk about delay in the payment of the money. Two years have already elapsed since the deal was concluded. Neither did the buyer pay the money nor did the owner hand the property over. Should the sale be deemed void?

A: The sale cannot be deemed void because of the delay in paying the purchase price and taking possession of the property, albeit without stipulating that in the agreement. However, the vendor has the right to revoke the agreement after three days from the date of sale.
